The Mental Health Act 1983: Code of Practice 2015 ('the MHA Code') provides statutory guidance to registered medical practitioners, approved clinicians, managers and staff of providers, and approved mental health professionals on how they should carry out their duties under the MHA.
All those for whom the MHA Code is statutory guidance must ensure that they are familiar with its contents.
The MHA Code requires NHS commissioners, NHS providers, Local Authorities and Police forces to have local partnerships and a jointly agreed local policy in place that governs all aspects of the use of s.135 and s.136 MHA to ensure that people experiencing mental health crises receive the right medical care from the most appropriate health agencies as soon as possible.
It is crucial that people experiencing mental health crises, including those within the Criminal Justice system, access appropriate health services at the earliest opportunity and this Policy sets out the commitment of all signatory agencies, across Sussex, to work effectively together to ensure s.135 and s.136 MHA are executed according to high professional standards, ensuring implementation of parity of esteem for all those
experiencing a mental health crisis.
